General

These general Terms and Conditions apply when you (“Customer” or “you”) place an order from Julia Brown (“I” or “me” or “the Operator”) on http://www.juliabrownart.com, (the “Website”).

By accepting these Terms and Conditions, you confirm that you are at least 18 years old or have your legal guardian’s permission and that you will comply with the Terms and Conditions.

I sell products to multiple jurisdictions and these Terms and Conditions are set out to be global.

By accepting these Terms and Conditions, you understand and accept that any order, purchase or transaction is made exclusively between Julia Brown and the Customer.

Orders

When you receive an order confirmation from me, your purchase order is accepted and a purchase agreement is entered into. I encourage you to save the order confirmation for any future contacts with me.

I may deny a purchase order for various reasons, for example if you provide incorrect personal data and/or have a record for non-payment of debt.

You may withdraw your order until it has been confirmed by me. I will then refund any payment that you, or your payment/credit card company, have made for the order.

I may cancel an order if the artworks ordered are already sold. I will then refund any amount paid and notify you about equivalent or similar artworks if such are available.

All artworks ordered remain my property until I have received full payment for them.

Customer Information

You are responsible for making sure that the personal data that you provide me with is correct and complete. You are responsible for all purchases made with your login details.

Please make sure that you keep your login details secret, and that no unauthorised persons have access to them.

Please contact me immediately if you suspect that an unauthorised person has obtained access to your login details. You can find out more about how I look after your data in my Privacy Policy.

Pricing & Shipping Fees

The prices indicated on the Website apply to orders placed on the Website.

All prices are in GPB (£ Sterling), and include VAT where specified. 

Shipping fees are given seperately when you add an item to your basket. They are calculated on dimensions and weight of your purchase, along with your postcode zone for the United Kingdom.

International shipping is available on request—please contact me (stating you shipping desination) for a quote and I will arrange this with you separately.

Please note also that local charges (such as currency conversion fees, credit or bank card fees, sales tax, customs duty etc.) may apply depending on where you live and local regulations.

Such charges are at your expense and will not be refunded.

Shipping & Delivery

Artworks in stock are normally delivered within the number of working days shown on the Website.

Please note: delivery time can vary for different countries. Delivery to some countries can take several weeks depending on local postal services.

In case of delay in delivery, I will inform you and continue to monitor the order.

Special Offers

From time to time I may, for specific artworks, offer more favourable conditions than those provided for in these Terms and Conditions, for example discounts, coupons, extended right of withdrawal or free returns.

Such more favourable conditions are valid only for a limited duration of time, or until the specific artworks are sold out, and may be cancelled by me at any time. On cancellation, the general Terms and Conditions shown on this page will apply without amendments.

Right to Withdrawal & Returns

You may withdraw your order by notifying me within 14 days from the day that you received the ordered artworks. To do this, send me notification by email to julia@juliabrownart.com containing your name, address, e-mail address, the order number and a specification of which artworks that the withdrawal relates to.​

You must then also, immediately and within 14 days from the date of the withdrawal notification, return the withdrawn artworks to me at your expense.

You are responsible for the condition of the artworks during the shipment back to me, and I therefore strongly recommend that you send these insured and well packaged, in good condition and in their original box and/or packaging.

When an order is withdrawn by you, I will refund the price that you have paid for the artworks withdrawn, including any shipping costs for standard delivery to you. From the amount to be refunded I will however deduct any depreciation in value of the artworks if such depreciation is due to that you have handled them to a greater extent than necessary to determine their function or characteristics.

Shipping costs are further only refunded if the withdrawn artworks form a whole order and are therefore not refunded if you cancel only parts of an order. I will pay the amount to be refunded as soon as possible and within 14 days of the withdrawal notification. I will however delay the payment until I have received the withdrawn artworks or proof that they have been sent to me (certificate of delivery).

I will then refund your payment with the same payment method that you used to pay for your order, unless otherwise agreed.

Your right to withdrawal does not apply to contracts which:

• relate to a service which has been fully performed, if by placing the order you have consented to commencement of performance of the service and acknowledged that there would be no right to withdrawal after performance of the service;
• relate to goods or a service for which the price is dependent on fluctuations on the market which I cannot control and which may occur during the period between you receiving the withdrawn artworks and your notification to me of the withdrawal of the order;
• relate to artworks (for example, commissions) which have been made in accordance with your specifications or which otherwise are clearly personalised;
• relate to digital artwork which is supplied other than on a tangible medium, if you have expressly consented to delivery in such way and acknowledged that there would be no right to withdrawal;
• relate to cultural events, sporting events, or any other similar leisure activity, food service, catering, or any other similar service, accommodation, transportation of goods or vehicle rental, where I am to provide the service on a specific day or during a specific period.

Limitation of Liability

Your use of any information or materials on this website is entirely at your own risk, for which I shall not be liable. It is your own responsibility to ensure that any artworks, services or information available from me, or through this website, meet your specific requirements. I do my best to secure any hanging fixtures on artworks throughly and properly, however I do not accept responsibility for any failures and resulting damage to property. Please check you are satisfied that any artwork hanging fixtures are sound and in good working order before you use them to hang purchased artworks.

Where applicable mandatory law does not provide otherwise, my liability is limited to direct damages and under no circumstances am I liable for indirect damages such as loss of earnings etc.

Intellectual Property Rights

This Website contains material which is owned by or licensed to Julia Brown. This material includes, but is not limited to, the design, layout, look, appearance, written content, images and graphics, trademarks, company names, product names and information on products and services.

Reproduction in any form is prohibited without the prior written consent of Julia Brown.

All trademarks reproduced in this Website, which are not the property of, or licensed to Julia Brown, are acknowledged on the Website.

Waiver

I do not provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this Website for any particular purpose. This includes any image or typographical errors on the Website, such as errors in artworks descriptions, technical specifications, inaccurate prices or incorrect information with regards to whether an artwork is in stock.

I am entitled to rectify any obvious errors and, at any time, to change or update the information on the Website accordingly.

You acknowledge that such information and materials may contain inaccuracies or errors and I expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Changes to these Terms and Conditions

I may change these Terms and Conditions at any time. I will then set forth the changed Terms and Conditions on the Website and they will enter into force once you have accepted them (in connection with a new order through the Website or while browsing the Website).

Governing Law and Disputes

Your use of this Website and any dispute arising out of such use of the Website is subject to the laws of England, Northern Ireland, Scotland and Wales.
